Fees and Charges for Services, Surveys, Inspections and Related Matters Provided or Required by the Cayman Islands
Shipping Registry (CISR) and the Maritime Authority of the Cayman Islands (MACI).
This notice is directed primarily at:
- Service providers providing services to Cayman Islands ships;
- Owners, managers or operators of Cayman Islands ships, or their agents;
- Masters of Cayman Islands ships;
- Other users of services provided by the Cayman Islands Shipping Registry (CISR) or the Maritime Authority of the Cayman Islands (MACI).
1. Application:
1.1 Notice is hereby given that the fees and charges to be applied by the Maritime Authority of the Cayman Islands (the Authority) with respect to the services provided or undertaken by the Authority are as set out in this Notice, with effect, subject to subparagraphs 1.3 and 1.5, from 01 October 2006 and, subject to subparagraphs 1.4, will remain in effect until superseded by a further Notice.
1.2 Subject to subparagraph 1.5, the fees and charges applicable up to 30 September 2006 are as set out in the Merchant Shipping (Fees) Regulations 2004.
1.3 Any services commenced or requests and applications for services accepted by the Authority prior to 01 October 2006 and not completed by this date will be charged at the applicable rate set out in the Merchant Shipping (Fees) Regulations 2004, providing the completion of such work is not unduly delayed through no fault of the Authority.
1.4 Whilst every effort will be made to provide at least 30 days notice of any changes to the levels of fees and charges as set out in this Notice, the Authority reserves the right, in its discretion, to vary fees without notice either generally or in a particular case.
1.5 Concurrent with this Notice, the Merchant Shipping (Fees) Regulations 2004 are to be amended with a commencement date for the amended Regulations set to coincide with the date on which this Notice takes effect (i.e. 01 October 2006). The amended Fees Regulations will retain only certain fees and charges together with some provisions relating to the recovery of certain costs etc. and the Regulations will operate in parallel with this Notice. In the interest of completeness, those items that will be retained in the amended Fees Regulations are also included in this Notice. Providing the amended Fees Regulations do come into effect, as planned, on 01 October 2006, the introduction of all the revised fees and charges will take place on that date. Should the commencement date for the revised Regulations be delayed, then the level of fees and charges will remain as set out in the Merchant Shipping (Fees) Regulations, 2004 until such time as these are replaced by the revised Regulations.
1.6 By supplementary Notice, advice will be issued at the appropriate juncture regarding the commencement of the revised Fees Regulations.
